NOTICE TO BIDDERS hereby is given that Bids are invited and will be received as set forth below:

6) CONTRACT DOCUMENTS:
Contract documents may be received at No Cost, Monday thru Friday, except legal holidays, from 9:00 A.M. to 4:00 P.M., prevailing time, at the ENGINEER’s address. All bidders must receive the contract documents from the Authority, failure to do so will be cause for rejection of that bid.
7) USE OF CONTRACT DOCUMENTS:
Contract Documents are available solely for the purpose of obtaining Bids and not to confer a license or grant form any other purpose.

Bid Guarantee is required in an amount not less than ten percent (10%) of the total amount indicated in the Bid, but not in excess of Twenty Thousand Dollars ($20,000).
10) CONSENT OF SURETY:
A certificate is required from a surety company stating that it will provide bond(s) in the form and amounts as stated in the Contract Documents.
11) SUBMISSION OF BIDS:
Bids shall be placed in sealed envelopes and must be received by Owner prior to the Date and Time indicated for Public Bid Opening and Reading in Paragraph #12. No Bids will be received after the indicated Date and Time.

13) STATUTORY REQUIREMENTS:
This Bid and Contract are subject to NJ Local Public Contracts Law (N.J.S.A 40a:11-1 et seq. and 2012, c. 25) and Bidders are required to comply with all where applicable Laws and Regulations including the N.J.S.A.10:5-31 et seq., and N.J.A.C. 17:27 (Affirmative Action) P.L. 1999, C.238 (Public Works Contractor Registration), P.L. 1963, C.150 (Prevailing Wages) and P.L. 2004, C.57 (New Jersey Business Registration Requirements).
14) REJECTION OF BIDS
Owner reserves the right to reject any or all Bids and to waive any immaterial defect or informality in any Bid, if deemed in the best interest of Owner.

Rejection of all Bids and Authorization to Re-Bid the Furnishing and Delivery of Clarifier/Grit Collector Parts
1. The Executive Director is hereby authorized and directed to advise in writing all bidders of the Authority’s decision to
reject all bids; and
2. The Executive Director is hereby authorized and directed to publish a public notice of its decision to reject all bids; and
3. The Executive Director, in accordance with and compliance with its Invitation to Bid is hereby authorized and directe
to return all bidders bid guarantee(s).
4. The Executive Director is authorized to re-advertise the contract for public bid.

LEGAL NOTICE TO BIDDERS
Notice is hereby given that electronic bids will be received by an aggregation group consisting of thirteen (13) New Jersey Sewerage and Municipal Utility Authorities and/or local governmental units, (the “Participating Members”), referred to collectively and informally herein as the New Jersey Sewerage and Municipal Utility Authority Electrical Supply Aggregation, or “NJSMUAESA”), on October 6, 2026 at 11:00 a.m. for electric generation service. Should not all account Bid Groups be awarded on October 6, 2026, then bidders may be asked to submit bids again on
October 7, 2026 at 11:00 a.m.
PRICES QUOTED MUST INCLUDE ALL COST COMPONENTS FOR ELECTRIC GENERATION SERVICE AS SPECIFIED IN THE BID PRICING FORMS. Bids must conform to the specifications and only approved qualified bids will be accepted. Only NJBPU-licensed electric power suppliers are eligible to participate. The deadline for submission of optional questions and comments and mandatory Stage 1 qualifications documents is close of business on September 18,2026. An addendum to the RFB, if any, occasioned by supplier questions and comments, will be issued by no later than September 24, 2026.
Specifications and bidding documents, including instructions for submission of qualifications documents and bid prices, may be obtained from Gabel Associates, the Energy Agent for the NJSMUAESA, by submitting an email request to:

All price quotations and contracts shall be subject to the provisions of P.L.1977,c.33 requiring submission of a statement of corporate ownership, the provisions of P.L.1975, c.127 concerning equal employment opportunity and affirmative action and the provisions of N.J.S.A. 52:32-44 requiring New Jersey Business Registration and the collection of use taxes. Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et. Seq. and N.J.A.C. 17:27.
